TERMS OF ACQUISITION

By acquiring a work from Aicha Art Gallery, you enter into a dialogue with the artist and the work itself. The following terms define the architecture of this relationship.

1. The Works & Authenticity

​

  • Provenance: All works are created and sold exclusively by Aicha Haddouchi. I reserve the right to curate complementary pieces from other artists, which will always be clearly distinguished from my own oeuvre.

  • Representation: I use high-fidelity photography to represent the texture and palette of each painting. However, please acknowledge that digital screens vary; the physical work may possess nuances of tone and depth that technology cannot fully render. Therefore, I cannot guarantee that your display reflects the true color with absolute precision.

 

2. The Contract

  • Formation: A contract is formed when you place an order by contacting me at aicha@aicha.gallery or completing the checkout process. You will receive an acknowledgment that your order has been received.

  • Processing: The contract is firmly established once payment is confirmed and you are notified that the order is being processed.

  • Governing Law: This agreement is anchored in and covered by the laws of Bulgaria.

 

3. The Financial Exchange

  • Payment Methods: To secure a work, payment is accepted via Bank Transfer, MoneyGram, or Western Union.

  • Bank Details:

    • IBAN: BG19UNCR70001598028944

  • Duties & Taxes: While original art is often exempt from certain duties, you are responsible for contacting your local authorities regarding potential import costs. Covering these additional costs is your sole responsibility.

4. The Journey (Shipping & Delivery)

​

  • Preparation Timeline: Upon receipt of the order, please allow 5 working days for preparation. If the work requires an export certificate from the National Gallery, this period extends to 10 working days.

  • Shipping Costs: The cost of the journey is calculated based on the delivery address, shipping option, and the work's weight/dimensions. This specific cost will be communicated to you via email and added to the final price.

  • Dispatch: Once the shipment begins (no later than 10 working days after payment), you will receive a tracking number to follow the work’s location.

  • Reception: Deliveries typically occur between 9:00 and 18:00, Monday through Friday. Please ensure you are present at the address to receive the work. I cannot accept responsibility for loss or damage if you instruct the courier to leave the work unattended.

  • Inspection: You must inspect the work upon delivery. Any damage must be reported to the driver immediately at the time of delivery. If the work is lost or damaged in transit, please notify me as soon as possible.

  • Redirecting: If you change the delivery address after the work has been dispatched, you will be charged for the redirection costs.

5. The Return (Right of Withdrawal)

​

  • The Window: If the work does not resonate with your space, you have the right to return it within 14 days of delivery. To initiate this, you must contact us within this 14-day window.

  • Refund Policy: You will receive a refund for the value of the product only. Shipping costs are non-refundable.

  • The Return Journey: The work must be shipped back within 14 days of your cancellation notice. You are responsible for the cost and safety of the return shipment.

  • Condition: The work must be packed appropriately to prevent damage. Upon return, the work will be inspected; any damage found will reduce the refund amount accordingly. Refunds are processed within 5 working days of receiving the returned work.

7. Force Majeure

Rarely, events beyond control (accidents, severe weather, fire, war, civil unrest, or third-party defaults) may pause the journey of your artwork. In such cases, I may be prevented from delivering on schedule, but communication will remain open.
